Regulations You Need to Know

Regulated “Medical Waste“

biohazardous-waste-disposal

Medical waste is outlined in Texas Administrative Code (§326.3(23), §1.132) as the following: “treated and untreated special waste from health care-related facilities that is comprised of:

  1. Animal waste (waste from animals that have been intentionally exposed to pathogens)
  2. Bulk blood, bulk human blood, bulk human body fluids
  3. Microbiological waste
  4. Pathological waste
  5. Sharps (hypodermic needles)”

If your facility only produces “sharps”, you can rest assured that’s the majority of medical waste for facilities (~80% of our Austin clients also only produce “sharps” as their medical waste.)

Learn about COVID-19 waste disposal regulations here.

Facilities of Regulated Medical Waste

medical-waste-removal

Determining if your “facility” is required to properly dispose of your “medical waste” is a process of discerning what your facility is “not”, as per “30 TAC”:

“Health care-related facilities do not include:

(A) single or multi-family dwellings; and

(B) hotels, motels, or other establishments that provide lodging and related services for the public.”

If your facility is a “family dwelling” or an “establishment providing lodging for the public”, then follow these recommendations for safely disposing of sharps and syringes (GI-418.)

If your facility is not a “family dwelling” or an “establishment providing lodging for the public”, then you are required by law to properly dispose of medical waste.

Dispose of Regulated Medical Waste

The risks of improper medical waste disposal are clear.

The City of Austin (Harrison County) defers proper disposal of regulated waste to “private companies available to dispose of medical wastes”.

BioMedical Waste Solutions is one of the very few private Austin medical waste disposal companies that are registered and permitted by Texas state to handle, transport, store, destroy, and dispose of medical waste and provide Austin medical waste disposal services.

Are there any additional fees?

Unfortunately in our industry, many companies’ quotes look low-cost, but unscrupulously, they have sneaked in hidden fees and/or have hidden ways to administer “price increases” (“PIs”) in their contracts for as much as 18% twice per year! (That would double your cost every ~4 years!)

We run an honest, fair, and ethical business, so we have no hidden fees and we guarantee we will refrain from raising our price. Period.

What is the method of disposal for medical waste?

The method of disposal for medical waste typically involves processes like incineration, autoclaving, chemical disinfection, and landfill disposal. Chemical disinfection and landfill are also used, adhering to regulations to prevent environmental contamination and ensure public safety.

What are the guidelines for medical waste disposal in Texas?

In Texas, medical waste disposal is guided by the Texas Administrative Code. It includes materials like animal waste (from animals exposed to pathogens), bulk blood and body fluids, microbiological waste, pathological waste, and sharps. Facilities generating medical waste, particularly sharps, must manage this waste responsibly. Options include self-transporting to an authorized facility, using registered medical waste transporters, or on-site treatment following specific procedures.

How do I dispose of needles in Austin?

In Austin, needles should be disposed of safely to prevent injury and environmental harm. Residents are advised to place used needles in a sturdy, puncture-proof container with a secure lid. Once the container is full, it should be sealed and disposed of properly. Austin provides a drop-off kiosk for safe disposal of needles and other sharps at the Travis County Constable Precinct 5, located at 1003 Guadalupe St. This drop-off service is available Monday through Friday from 8 a.m. to 5 p.m. It’s important to note that needles should not be thrown loosely into the trash or recycled.

How do I dispose of a sharps container near me?

For locating a nearby disposal option for sharps containers, you may contact local health departments, public works departments, or use online resources to find authorized disposal sites or programs in your area.
